In both Riverside and San Bernardino County Family law matters, Mediation is scheduled when a dissolution is filed and the parents cannot reach an agreement on the custody and visitation schedule with the children.
The Mediator will meet with both parties together to try and reach an agreement as to what is in the BEST INTEREST OF THE CHILDREN.
The mediator will take into consideration the following as well as other issues:
Work Schedule of the parties
Drug/Alcohol/tobacco use of the parties
Corporal punishment used by the parties
Domestic Violence Issues
Age of the children
In Hemet, Riverside, San Bernardino and Rancho Cucamonga courts, the mediator's recommendation is quite regularly adopted by the court in reaching its decision concerning custody and visitation issues.
If you do not agree with the mediator's recommendation, you can request a 730 evaluation where the parties will meet with a court appointed psychiatrist for in depth interview with both parents and the children. If further intervention is required, Minors' Counsel can also be appointed.
Please note that unless there are instances of substance abuse, physical or emotional abuse or domestic violence, the State of California strives for frequent and continuing visitation with both parents.
When going to your mediation appointment, please arrive on time, be neatly dressed, no excessive jewelry, cover tattoos, etc. Be calm and be reasonable, remember, the goal is what is in the best interest of the children.
